AN ORDINANCE MODIFYING
THE CONTRACTUAL RATES PAID TO ALLIED WASTE SERVICES FOR RESIDENTIAL
AND COMMERCIAL GARBAGE COLLECTION SERVICE BY ALLIED WASTE SERVICES;
AMENDING THE RATE OF RESIDENTIAL AND COMMERCIAL GARBAGE SERVICE CHARGED
TO THE CITIZENS OF BASTROP, TEXAS FOR ADMINISTRATIVE COSTS AND SERVICE
RATES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,
pursuant to the authority provided by the Bastrop Code of Ordinances,
Chapter 11, the City of Bastrop, Texas has contracted with Allied
Waste Services to provide the citizens of Bastrop with residential
and commercial garbage collection service; and
WHEREAS,
Section 13.02 (a) of the agreement by and between the City of Bastrop
and Allied Waste Services, related to the provision of garbage collection
services, provides for periodic modification of garbage collection
rates charged by Allied Waste Services, to reflect changes in the
cost of operations by Allied Waste Services, as reflected by fluctuations
in various Consumer Price Indices; and
WHEREAS, Allied
Waste Services last increased its rates to the City of Bastrop in
June 2004; and
WHEREAS,
it is necessary for the City to increase rates charged for residential
and commercial services, to accommodate the increase in administrative
costs and service rates charged by Allied Waste Services.
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
PART 1:
That, effective September 1, 2006 the rates paid by the City of Bastrop
shall be modified, as shown on Attachment A.
PART 2:
That, effective September 1, 2006 the rates paid by the residential
and commercial customers of Bastrop shall be modified, as shown on
Attachment B.
PART 3: That
all ordinances, resolutions and orders heretofore passed, adopted
and made, or any part of the same, affecting rates and charges for
residential and commercial garbage service rates of the City of Bastrop,
which are in conflict with this Ordinance, shall be, and the same
are hereby, in all things repealed to the extent that the same conflict
with this Ordinance, or with the laws of the State of Texas.
PART 4: This Ordinance shall take effect upon
the date of final passage noted below in accordance with the City's
Charter, Code of Ordinances, and the laws of the State of Texas.
