ORDINANCE NO. 2006-19


AN ORDINANCE GRANTING A REQUEST TO REZONE AN AREA ZONED "I-P" - INDUSTRIAL PARK TO ZONING DESIGNATION "C-1" COMMERCIAL (LIGHT) A +/- 0.5900 ACRE TRACT AND A +/-4.7190 ACRE TRACT NORTH OF HIGHWAY 71 EAST GENERALLY LOCATED AT 2620 HIGHWAY 71 EAST, BASTROP, BASTROP COUNTY, TEXAS; AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, Barbara Humble (hereinafter referred to as an "Applicant") submitted a request to rezone an area currently zoned "I-P" - Industrial Park to a zoning designation "C-i"- Commercial (Light) a +/ 4.7190 acre tract of land and a +/- 0.5900 acre tract located north of State Highway 71 East or generally located at 2620 Highway 71 East in Bastrop, Bastrop County, Texas, hereinafter referred to as "the Property" and more particularly shown on a site plan accompanying the application hereto as Exhibit "A"; and

WHEREAS, the Property is currently zoned as "I-P" - Industrial Park and vacant; and

WHEREAS, the Applicant previously applied for a zoning change from "I-P" - Industrial Park to "C-2" - Commercial (Heavy) in February, 2006 and the Planning and Zoning Commission held a public hearing March 30, 2006, and recommended that the item be tabled and, hence, never acted upon by the City; and

WHEREAS, on April 28, 2006, Applicant withdrew her prior request for a zoning change from "I-P" - Industrial Park to "C-2" - Commercial (Heavy) for the Property and subsequently submitted a new request to rezone the Property from "I-P" - Industrial Park to a zoning designation "C-i" Commercial (Light); and

WHEREAS, pursuant to Section 10.4 of the City's Zoning Ordinance, notice of the rezoning request was given to all property owners located within two hundred feet of the Property, and the Planning and Zoning Commission of the City of Bastrop held a public hearing on the Applicant's rezoning request April 27, 2006; and

WHEREAS, after notice and hearing, the Planning and Zoning Commission has recommended approval of the Applicant's request for rezoning; and

WHEREAS, pursuant to Section 10.4 of the City's Zoning Ordinance, notice of rezoning request was given as required by the ordinance, and the City Council of the City of Bastrop held a public hearing on the Applicant's rezoning request on June 13, 2006 to consider the request; and

WHEREAS, after consideration of the information presented, City Council finds that it is in the public interest to approve the Applicant's rezoning request.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:

Part 1: The tracts owned by the Applicant, said Property being more particularly described as a +/- 4.7190 acre tract of land and a +/- 0.5900 acre tract located north of State Highway 71 East or generally located at 2620 Highway 71 East in Bastrop, Bastrop County, Texas are hereby rezoned from zoning designation "I-P" - Industrial Park to zoning designation "C-1" - Commercial (Light).

Part 2: This ordinance shall take effect upon passage and in accordance with the laws of the State of Texas.

READ and ACKNOWLEDGED on First Reading on the 13th day of June, 2006.
READ and ACKNOWLEDGED on the Second Reading on the 27th day of June, 2006.
