ORDINANCE NO. 2008 - 25

AN ORDINANCE GRANTING A CONDITONAL USE PERMIT TO THOMAS AND JUDY HOOVER TO ALLOW FOR A DOG GROOMING BUSINESS TO OPERATE IN AN AREA ZONED "NS"-NEIGHBORHOOD SERVICES FOR A +7- 0.319 OF AN ACRE OUT OF BUILDING BLOCK 3 GENERALLY LOCATED AT 803 COLLEGE STREET, BASTROP, BASTROP COUNTY, TEXAS; AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, Thomas and Judy Hoover (hereinafter referred to as an "Applicant") submitted a request for a Conditional Use Permit on May 5, 2008 to allow for a Dog grooming business to operate in an area currently zoned "NS"- Neighborhood Services a +/ 0.319 of an acre out of Building Block 3 or generally located at 803 College Street in Bastrop, Bastrop County, Texas, hereinafter referred to as "the Property" and more particularly shown on a site plan accompanying the application hereto as Exhibit "A"; and

WHEREAS, pursuant to Section 36.2 of the Zoning Ordinance of the City of Bastrop, Texas, manufactured houses may be located in areas zoned "SF7", Single Family Residential, pursuant to terms of an approved Conditional Use Permit; and

WHEREAS, pursuant to Section 33 of the Zoning Ordinance of the City of Bastrop, Texas, a public notice has been given, and a public hearing was held on May 29, 2008, by the Planning and Zoning Commission (hereinafter referred to as the "Commission") regarding the Applicant's request for a Conditional Use Permit; and

WHEREAS, following a public hearing on May 29, 2008, and consideration of the evidence and testimony presented therein, the Commission recommended approval of the Applicant's request for a Conditional Use Permit, subject to certain conditions set forth herein; and

WHEREAS, pursuant to Section 33 of the Zoning Ordinance of the City of Bastrop, Texas, a public notice has been given, and a public hearing was held on June 10, 2008, by the City Council regarding the request for a Conditional Use Permit by the Applicant; and

WHEREAS, after consideration of the information presented, City Council finds that it is in the public interest to approve the requested Conditional Use Permit to provide for and allow an dog grooming business to operation generally located at 803 College Street and legally described as being a +/ 0.319 of an acre out of Building Block 3 in Bastrop, Bastrop County, Texas in an area zoned "NS", Neighborhood Services, subject to conditions noted herein.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:

Part 1: That the Conditional Use Permit requested by Thomas and Judy Hoover generally located at 803 College Street and legally described as being a +/-0.319 of an acre Building Block 3 in the city limits of Bastrop, Texas in an area zoned "NS", Neighborhood Services is hereby approved , subject to compliance with the following conditions:

  1. All necessary building permits, site development permit for the site are acquired to bring 803 College into compliance with the development standards of the City of Bastrop.
  2. The owners of the business follow the current animal ordinance required by the City of Bastrop regarding restraint requirements for dogs on private property.

3. A Building Permit/Certificate of Occupancy must be applied for and secured within three (3) months of the approval of the conditional use permit.

Part 2: This ordinance shall take effect upon passage and in accordance with the laws
of the State of Texas.
