AN
ORDINANCE GRANTING A ZONING DESIGNATION OF C1, COMMERCIAL-i (LIGHT)
FOR A +/- 25.654 ACRE TRACT LOCATED APPROXIMATELY 200 FEET NORTH OF
THE INTERSECTION OF OLD AUSTIN HIGHWAY AND HASLER BOULEVARD, BASTROP
COUNTY, TEXAS; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, Smithville Hospital Authority (hereinafter
referred to as "Applicant") submitted a request for a zoning
designation of C1, Commercial-1 (Light) for a +/25.654 acre tract
of land located approximately 200 feet north of the intersection of
Old Austin Highway and Hasler Boulevard, Bastrop County, Texas, hereinafter
referred to as "the Property" and more particularly shown
on a site plan accompanying the application hereto as "Exhibit
"A"; and
WHEREAS,
the Property is currently Agriculture-Open Space and is vacant; and
WHEREAS,
pursuant to Section 10.4 of the City's Zoning Ordinance, notice of
the zoning request was given to all property owners located within
two hundred feet of the Property, and the Planning and Zoning Commission
of the City of Bastrop held a public hearing on the Applicant's rezoning
request January 25, 2007; and
WHEREAS,
after notice and hearing, the Planning and Zoning Commission has recommended
approval of the Applicant's request for zoning; and
WHEREAS,
pursuant to Section 10.4 of the City's Zoning Ordinance, notice of
the zoning request was given as required by the ordinance, and the
City Council of the City of Bastrop held a public hearing on the Applicant's
zoning request February 13, 2007 to consider the request, and
WHEREAS,
after consideration of the information presented, City Council finds
that it is in the public interest to approve the Applicant's zoning
request.
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:
Part 1: The tract
owned by the Applicant, said Property being more particularly described
as a +/-25.654 acre tract of land located approximately 200 feet north
of the intersection of Old Austin Highway and Hasler Boulevard, Bastrop
County, Texas is hereby zoned C1, Commercial-1 (Light).
Part 2: This ordinance
shall take effect upon passage and in accordance with the laws of
the State of Texas.
READ and ACKNOWLEDGED on First Reading on the 13th day of February,
2007.
READ and ADOPTED on Second reading on the 27th day of February, 2007.
