AN ORDINANCE PROVIDING FOR A PORTION OF HILL STREET, A PUBLIC
STREET LOCATED IN BASTROP, TEXAS, TO BE CLOSED TO THROUGH TRAFFIC
IN THE VICINITY OF THE WEST CAMPUS/ NINTH GRADE CENTER SCHOOL BUILDING
BETWEEN ELM STREET AND THE NORTH ENTRANCE TO THE HILL STREET PARKING
LOT DURING THE SCHOOL DAY, 8 A.M. TO 4 P.M., MONDAY THROUGH FRIDAY
AND ON OTHER OCCASIONS AS DETERMINED TO BE NECESSARY FOR PUBLIC SAFETY
BY THE CITY MANAGER, AND PROVIDING FOR THE TERMS AND CONDITIONS OF
SUCH CLOSURE.
WHEREAS, the Bastrop Independent School District
("BISD") has requested that Hill Street be closed to through
traffic during the school day; and
WHEREAS,
the City Council of the City of Bastrop has reviewed that technical
memorandum dated April 16, 2007 prepared by K. Friese & Associates,
Inc. for the City of Bastrop regarding a traffic study of Pedestrian
& Traffic Observations and Recommendations for the Hill Street
Project at Bastrop High School which made recommendations for the
improvement of pedestrian safety on Hill Street; and
WHEREAS,
a public hearing was conducted on whether to implement recommendations
of K. Friese relating to the closure of Hill Street to through traffic
in the vicinity of the West Campus/Ninth Grade Center School building
between Elm Street and the North Entrance to the Hill Street Parking
Lot during the school day (8 a.m. to 4 p.m.) as more clearly shown
on the diagram attached hereto as Exhibit A; and
WHEREAS,
the City Council of the City of Bastrop finds that this intermittent
street closure on Hill Street is necessary for the public safety and
should be implemented; and
WHEREAS,
upon considering the request of BISD and additional information pertaining
to the request, the City Council now finds that the utilities existing
in the area of the streets, alley, and/or public right-of-way will
not be affected by this intermittent closure;
NOW THEREFORE, BE
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP TEXAS:
PART 1: That Hill Street
shall be closed to through traffic in the vicinity of the West Campus/Ninth
Grade Center School building between Elm Street and the North Entrance
to the Hill Street Parking Lot during the school day (8 a.m. to 4
p.m.) as more clearly
shown on the diagram attached hereto as Exhibit "A" attached
hereto and made a part of this ordinance for all purposes.
PART 2: That said portion
of Hilt Street is not needed for public purposes during the hours
of closure and it is in the public interest of the City of Bastrop
to abandon said described portion of Hill Street during school hours.
PART 3: That the closure
provided for herein shall extend only to that portion of the public
right of way in and to Hill Street described in PART I of this Ordinance,
and shall be construed only to that interest the governing body of
the City of Bastrop may legally and lawfully close.
READ and Acknowledged on
First Reading on the 10TH day of July 2007.
A notice of the time and
place, where and when this Ordinance would be given a public hearing,
read, acknowledged, and considered for action by the Council, was
published in the Bastrop Advertiser, a daily newspaper of general
circulation in the City of Bastrop, Texas, said publication being
on the 5th day of July 2007, and also on the 7th day of July 2007,
the same being more than twenty-four (24) hours prior to the time
designated for said public hearing. Following at least 14 days after
such opportunity for the public to be heard, and prior to the closure
involved, said Ordinance was passed on second and final reading.
