AN ORDINANCE GRANTING
A REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW A CONTRACTOR'S YARD
WITH OUTDOOR EQUIPMENT STORAGE OVER 8 FEET IN HEIGHT AND A HELIPAD
(NO FUEL STORAGE) IN AN AREA ZONED "L I," LIGHT INDUSTRIAL
LOCATED IN THE CITY LIMITS OF BASTROP, TEXAS, DETAILING CONDITIONS
RELATED THERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Don Furry. owner of 4 Nietos, LTD, of Bastrop,
TX (hereinafter referred to as the "Applicant"), the authorized
representative for the Bastrop Economic Development Corporation. property
owner, filed a request for a Conditional Use Permit on November 23.
200 to allow a Contractor's Yard with outdoor equipment storage over
8 feet in height and a Helipad (no fuel storage) for property legally
described as being a +/- 4.0 acre tract (Lot 2-A), situated in the
Bastrop Town Tract, A-11 and the Stephen F. Austin Survey, A-2, being
now a part of Reserve Areas A & B and Lot 2. Block F of the Bastrop
Business and Industrial Park, Phase 1, Bastrop. Bastrop County. Texas,
as shown on the applicable site plan in Exhibit "A," attached
hereto and incorporated herein for all purposes, in an area zoned
"L I" Light Industrial: and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on December 29, 2005 by the Bastrop Planning & Zoning Commission
regarding the request for a Conditional Use Permit bv_ the Applicant:
and
WHEREAS,
following a public hearing on December 29, 200 and consideration of
the evidence and testimony presented therein, the Commission recommended
approval of the application: and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on January 10, 2006 by the City_ Council regarding the request for
a Conditional Use Permit by the Applicant, and
WHEREAS,
the City Council finds that it is in the public interest to approve
the requested Conditional Use Permit to permit a Contractor's Yard
with outdoor equipment storage over 8 feet in height and a Helipad
(no fuel storage) in an area zoned "L I," Light Industrial,
subject to the conditions noted herein.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP. TEXAS:
Part 1: The Conditional Use Permit requested
by Don Furry, owner of 4 Nietos, LTD, as authorized representative
of the Bastrop Economic Development Corporation, to allow a Contractor's
Yard with outdoor equipment storage over 8 feet in height and a Helipad
(no fuel storage) on property legally described as being a +/- 4.0
acre tract (Lot 2-A), situated in the Bastrop Town Tract, A-I1 and
the Stephen F. Austin Survey, A-2. being now a part of Reserve Areas
A & B and Lot 2, Block F of the Bastrop Business and Industrial
Park. Phase 1, Bastrop.
Bastrop County. Texas
in an area zoned "L I" Light Industrial is hereby approved,
subject to compliance with the following conditions, if any:
and
Part 2: This ordinance shall take effect upon
passage and in accordance with the laws of the State of Texas.
