AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS, REVIEWING ARTICLE
7.200 "CURFEW FOR MINORS" IN CHAPTER 7 OF THE CITY CODE
OF ORDINANCES, ENTITLED "OFFENSES & NUISANCES"; CONTINUING
THE ARTICLE; PROVIDING A SAVINGS CLAUSE; AND, PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Council has determined that in
order to ensure and protect the property of the citizens of the City
of Bastrop, Texas, a review of Chapter 7 "Offenses & Nuisances"
Article 7.200 "Curfew for Minors" is in order; and
WHEREAS,
the City Council reviewed the Article's effects on the community and
the problems that the Article intended to remedy, and conducted a
public hearing on January 10, 2006 to determine whether the Article
continues to be needed; and
WHEREAS,
the City Council finds that the provisions in Chapter 7 Article 7.200
"Curfew for Minors" should be continued.
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
PART 1: That
Article 7.200 entitled "Curfew For Minors" in Chapter 7
of the City Code of Ordinances, entitled "Offenses & Nuisances,"
shall be continued without any changes to the Article.
PART 2:
That should any section, clause or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of this ordinance or any other
ordinance of the City as a whole or any part thereof, other than the
part so declared to be invalid.
PART 3: This Ordinance supersedes and repeals
all Ordinances or parts of Ordinances, if any, in conflict herewith,
however, such present Ordinances shall remain in full force and effect
until the effective date of this Ordinance.
PART 4: This Ordinance shall take effect upon
the date of final passage noted below, or when all applicable publication
requirements, if any, are satisfied in accordance with the City's
Charter, Code of Ordinances, and the laws of State of Texas.
READ and Acknowledged on First Reading on the 10th day of January
2006.
READ and Adopted on Second Reading on the 24th day of January 2006.
