AN ORDINANCE GRANTING
A REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW A HOME OCCUPATION
BE LOCATED IN AN AREA ZONED SINGLE FAMILY RESIDENTIAL - 7 DISTRICT
"SF-7"; DETAILING CONDITIONS RELATED THERETO; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Howard Nemerov and Grace Game of Bastrop,
TX, property owners, ("Applicants") filed a request for
a Conditional Use Permit on December 1, 200 for property generally
located at 310 Cedar Street, or legally described as being ±
0.3013 Acres out of Block 5, Lot 1. Riverview Heights, to allow a
home occupation to be located in an area currently zoned as Single
Family Residential - 7 District "SF-7'': and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on December 1. 200 by the Bastrop Planning & Zoning Commission
regarding the request for a Conditional Use Permit by the Applicants;
and
WHEREAS,
following a public hearing on December 1. 2005, and consideration
of the evidence and testimony presented therein, the Commission recommended
approval of the application, as long as they remain in compliance
with Chapter 12. Section 33 of the Code of Ordinances; and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on December 13, 200 by the City_ Council regarding the request for
a Conditional Use Permit by the Applicants: and
WHEREAS,
the City Council finds that it is in the public interest to approve
the requested Conditional Use Permit to permit a home occupation located
in an area zoned as Single Family Residential "SF7," subject
to the conditions noted herein.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
Part 1:
The Conditional Use Permit requested by Howard Nemerov and Grace Garne
as Owners of the Property, related to the Property generally located
at 3 10 Cedar Street, Bastrop, TX, to allow the operation of a home
occupation in an area zoned Single Family Residential - 7 District
"SF-7", is hereby approved, subject to compliance with the
following conditions, if any:

Part 2: This
ordinance shall take effect upon passage and in accordance with the
laws of the State of Texas.
