AN
ORDINANCE RATIFYING PREVIOUSLY ADOPTED CITY ORDINANCE NO. 9842 AS
AMENDED, RELATED TO THE HP, HISTORIC PRESERVATION OVERLAY SECTIONS
OF EXHIBIT A, CHAPTER 12, ZONING ORDINANCE, OF THE CITY OF BASTROP
CODE OF ORDINANCES OF 1995, AS AMENDED; CREATING THE BASTROP HISTORIC
LANDMARK COMMISSION; PROVIDING TAX INCENTIVES TO ENCOURAGE HISTORIC
PRESERVATION; ESTABLISHING PENALTIES FOR VIOLATIONS; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City of Bastrop, Texas is a Home Rule
municipality incorporated and operating under the Laws of the State
of Texas; and
WHEREAS,
the City of Bastrop, Texas, has determined that it is in the best
interest of the health, safety and welfare of its citizens to Ratify
and Continue the effect of Ordinance Number 98-42 as amended, also
known as the Historic Landmark Preservation Ordinance, to protect,
enhance and perpetuate landmarks or districts of historical and cultural
importance and significance as a matter of pubic policy and to promote
the economic, cultural, educational and general welfare of the public.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
Part 1:
That Ordinance No. 98-42 as amended, which due to an inadvertent
transcription/communications error, the effect of which being that
the regulatory text of Ordinance No. 98-42 as amended has not been
incorporated in the printed edition of the City Code, has been, continues
to be and remains in effect in its entirety, and is retroactively
ratified to the date of its adoption.
Part 2: All
ordinances and parts of ordinances that are in conflict with the terms
of this ordinance are hereby repealed.
Part 3:
This Ordinance shall take effect immediately or when all applicable
publication requirements, if any, are satisfied in accordance with
the City's Charter, Code of Ordinances, and the laws of State of Texas.
READ AND APPROVED on First Reading on the 12th day of September 2006.
READ AND ADOPTED on Second Reading on the 26th day of September 2006.
