ORDINANCE NO. 2006-10

AN ORDINANCE GRANTING A REQUEST TO CORRECT THE PROPERTY DESCRIPTION IN A WARRANTY DEED DATED APRIL 15, 1853 FILED WITH THE COUNTY CLERK, BASTROP COUNTY, WHEREIN THE TOWN OF BASTROP CONVEYED A TRACT OF LAND BY ORDINANCE TO ROBERT A. RUTHERFORD, AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Joseph David Crawford of San Antonio, Texas, and Frances Laura Welch of Pflugerville, Texas, property owners, ("Applicants") requested the Mayor and the City Council of the City of Bastrop consider a Correction Deed to correct an erroneous property description that was incorrectly recorded for a tract of land conveyed from the Town of Bastrop to Robert A. Rutherford of Bastrop, Texas, in a deed filed on April 15, 1853 with the Bastrop County Clerk's office which appears of record under Volume H, pages 661-662 for property generally located at 701 Hwy. 95, or legally described as being ± 18.286 Acres out of Blocks 106, 107, 114, 115, 128 129 and 130 (fraction); and

WHEREAS, the City Council finds that it is in the public interest to approve a requested `Correction Deed' and to authorize the legal description to be corrected in the Bastrop County Records, thereby reflecting the fact that the tract of land originally conveyed by the Town of Bastrop to Robert A. Rutherford is bordered by "Austin Street" instead of "Water Street," supported by the original description contained in an ordinance adopted by the Mayor and Alderman of the Common Council on April 15, 1853 (approximately).

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:

Part 1: The Correction Deed requested by Joseph David Crawford and Frances Laura Welch, as owners of the Property, generally located at 701 Hwy. 95, Bastrop, TX, be recorded in the Bastrop County Records to correct the legal description on the tract of land originally conveyed by the Town of Bastrop to Robert A. Rutherford by ordinance on April 15, 1853 (approximately) to correctly reflect that Clay, Pitt and Madison Streets, East of Main Street, are closed from Pine Street to Austin Street.

Part 2: That the Mayor direct the City Secretary to record the Correction Deed with the Bastrop County Clerk to effectuate the corrections herein approved.

Part 3: This ordinance shall take effect upon passage and in accordance with the laws of the State of Texas.

READ and Acknowledged on First Reading on the 14th day of February 2006. READ and Adopted on Second Reading on the 28th day of February 2006.
