AN ORDINANCE AMENDING
THE BASTROP CITY CODE CHAPTER 11, UTILITIES AND SOLID WASTE, ARTICLE
11, CONCERNING WATER AND WASTEWATER RATES AND CHARGES AND BULK WATER
SALES; AMENDING APPENDIX A, FEE SCHEDULE, ARTICLE 7.000 UTILITY RELATED
FEES -WATER RATES; REPEALING CONFLICTING PROVISIONS; PROVIDING FOR
SEVERABILITY; PROVIDING A PENALTY FOR VIOLATIONS; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Bastrop,
Texas has determined that in order to properly provide utility and
water service within the City it is necessary to amend the City Code
of Ordinances, Article 11, and Appendix A: Fee Schedule Article 7.000
Utility Related Fees, as noted below.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
PART 1: That Appendix A: of the Code, entitled Fee Schedule,
Article 7.000 Utility Related Fees, shall read as follows:

Sec. 7.300 Water Service Charges
[No change to (a)].
(b) Water
Charqe for Consumption by Customers Located Within City Limits:
In addition to the base Monthly Customer Charge noted in (a) above,
the following charges shall apply for all water consumed by customers
located inside the corporate limits of the City of Bastrop, regardless
of the size of meter used:

water consumed by customers located outside the corporate limits of
the City of Bastrop, regardless of the size of meter used:

PART 2: If any provision
of this ordinance or application thereof to any person or circumstance,
shall be held invalid, such invalidity shall not affect the other
provisions, or application thereof, of this ordinance which can be
given effect without the invalid provision or application, and to
this end the provisions of this ordinance are hereby declared to be
severable.
PART 3: That all
ordinances, resolutions and orders heretofore passed, adopted and
made, or any part of the same, affecting rates and charges for residential
and commercial electric rates of the City of Bastrop, which are in
conflict with this Ordinance, shall be, and the same are hereby, in
all things repealed to the extent that the same conflict with this
Ordinance, or with the laws of the State of Texas. All provisions
not amended herein shall remain in full force and effect.
PART 4: The Changes
noted in this Ordinance shall become effective during the first billing
cycle after the expiration of thirty (30) days following the date
when all applicable publication requirements, if any, are satisfied
in accordance with the City's Charter, Code of Ordinances, and the
laws of State of Texas.

Reading on the 27 th day of September 2005. READ and ADOPTED on Second
Reading on the 11th day of October 2005.
