AN ORDINANCE GRANTING
A REQUEST TO REZONE FROM "A/OS - AGRICULTURAL/OPEN SPACE"
TO "C- 1 - COMMERCIAL-1 (LIGHT)" FOR A 67.41 +/- ACRE TRACT
OF LAND OUT OF THE NANCY BLAKEY SURVEY A-98 WHICH IS LOCATED IN PECAN
PARK SUBDIVISION BASTROP, TEXAS, OWNED BY D M PECAN PARK ASSOCIATES,
LTD; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, Robert Leffingwell and Richard Hope, as
authorized representatives for D M Pecan Park Associates, LTD, (hereinafter
referred to as "Applicants") submitted a request to rezone,
from zoning designation "A/OS - AGRICULTURAL/OPEN SPACE"
to zoning designation "C1- COMMERCIAL-1 (LIGHT)," a 67.41
+/-acre tract out of the Nancy Blakey Survey A-98, property located
in Pecan Park Subdivision in Bastrop, Texas, hereinafter referred
to as "the Property" and described in a diagram at Exhibit
"A" attached hereto.
WHEREAS, the intended use of the Property is for projects
involving heavy retail and light intensity wholesale and commercial
uses of a service nature, and
WHEREAS,
pursuant to Section 10.4 of the City's Zoning Ordinance, notice of
the rezoning request was given to all property owners located within
two hundred feet of the Property, and the Planning and Zoning Commission
of the City of Bastrop held a public hearing on the Applicants' rezoning
request on June 30, 2005; and
WHEREAS,
after notice and hearing, the Planning and Zoning Commission has recommended
that the Applicants' request to rezone the Property to "C-1 COMMERCIAL-1
(LIGHT)" be approved; and
WHEREAS, pursuant to Section 10.4 of the City's Zoning
Ordinance, notice of the rezoning request was given as required by
the ordinance, and the City Council of the City of Bastrop held a
public hearing on the Applicants' rezoning request on June 30, 2005
to consider the request; and
WHEREAS, City Council finds that it is in the public
interest to approve rezoning of the Property to "C-1 COMMERCIAL-1
(LIGHT)."
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:
Part 1: The tract owned by D M PECAN PARK ASSOCIATES, LTD,
said Property being more particularly described as a 67.41 +/-acre
tract out of the Nancy Blakey Survey A-98, located in Pecan Park Subdivision
in Bastrop, Texas, is hereby rezoned from designation "A/OS -
Agricultural/Open Space" to zoning designation "C-1
COMMERCIAL-1 (LIGHT)."
Part 2: This Ordinance
shall take effect upon the date of final passage noted below, or when
all applicable publication requirements, if any, are satisfied in
accordance with the City's Charter, Code of Ordinances, and the laws
of State of Texas.
READ and ACKNOWLEDGED on First Reading on the 12th day of July 2005.
READ and ADOPTED on Second Reading on the 26th day of July 2005.
