AN ORDINANCE APPROVING
A REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A
BED AND BREAKFAST TO BE LOCATED AT 502 ELM STREET FOR A 0.344 ±
ACRE TRACT LOCATED OUT OF FARM LOT 4 WEST OF MAIN STREET IN AN AREA
ZONED "SF-7 - SINGLE FAMILY RESIDENTIAL AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Conor and Kay McAnally, Owners of the Property
in question, (the "Applicants") filed a request for a Conditional
Use Permit for property located at 502 Elm Street, to allow the operation
of a bed and breakfast to be located in an area currently_ zoned as
-'SF-7' Single Family Residential: and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on April 28, 2005 by the Bastrop Planning & Zoning Commission
regarding the request for a Conditional Use Permit by the Applicants
and at that time, the Commission recommended approval; and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on May 10. 2005 by the City Council regarding the request for a Conditional
Use Permit by the Applicants; and
WHEREAS,
the City Council finds that it is in the public interest to approve
the requested Conditional Use Permit to permit the operation of a
bed and breakfast to be located at 502 Elm Street in an area zoned
as "SF-7 Single Family_ Residential, subject to the conditions
noted herein.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
Part 1: The Conditional
Use Permit requested by Conor and Kay McAnally, as Owners of the Property,
to allow operation of a bed and breakfast on property in an area zoned
"SF-7" Single Family Residential at 502 Elm Street on 0.344
± acres located out of Farm Lot 4 West of Main Street, is hereby
approved.
Part 2: This ordinance shall take effect upon passage and in
accordance with the laws of the State of Texas.
READ and Acknowledged on First Reading on the 10th day of May 2005.
READ and Adopted on Second Reading on the 24th day of May 2005.
