AN ORDINANCE GRANTING A REQUEST FOR A CONDITIONAL USE PERMIT
TO ALLOW A HELISTOP FOR EMERGENCY USE TO BE LOCATED AT LAKESIDE HOSPITAL
FOR A 5.0 ± ACRE TRACT LOCATED OUT OF PHASE 1, LOT 1 IN LAKESIDE
SUBDIVISION IN AN AREA ZONED "C - 1" -COMMERCIAL AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Dr. Joseph Emmert. NEW MEDCO, Owner of the
Property in question, (the "Applicant") filed a request
for a Conditional Use Permit for property located at Lakeside Hospital
- Highway 71 East in Phase 1. Lot 1. Lakeside Subdivision, to allow
a helipad for emergency use to be located on hospital property in
an area currently zoned as "C-1" Commercial - I (Light):
and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas. a public notice has been given. and a public hearing was held
on March 3 1. 2005 by the Bastrop Planning & Zoning Commission
regarding the request for a Conditional Use Permit by the Applicant
and at that time, the Commission recommended approval: and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on April 12. 2005 by the City Council regarding the request for a
Conditional Use Permit by the Applicant: and
WHEREAS,
the City Council finds that it is in the public interest to approve
the requested Conditional Use Permit to permit a helistop to be located
at Lakeside Hospital - Highway 71 East in an area zoned as "C-I"
Commercial - I (Light). subject to the conditions noted herein.
NOW, THEREFORE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
Part I : The Conditional
Use Permit requested by Dr. Joseph Emmert, NEW MEDCO, as Owner of
the Property, to allow a helistop on property in an area zoned "C-I"
Commercial I (Light) at Lakeside Hospital - Highway 71 East on 5.0
± acres located out of Phase 1, Lot 1, Lakeside Subdivision,
is hereby approved.
Part 2: This ordinance shall take effect upon passage and in
accordance with the laws of the State of Texas.
