ORDINANCE NO. 2005-14


AN ORDINANCE GRANTING A REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW A MANUFACTURED HOME TO BE LOCATED AT 708 LINDEN STREET FOR A 0.475 + ACRE TRACT LOCATED OUT OF FARM LOT 7 EAST OF MAIN STREET IN AN AREA ZONED "SF-7" - SINGLE FAMILY RESIDENTIAL AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Crystal Stark. Owner of the Property in question. (the --Applicant") filed a request for a Conditional Use Permit for property located at 708 Linden Street. to allow a doublewide manufactured home to be located in an area currently_ zoned as "SF-7" Single Family_ Residential: and

WHEREAS, Applicant currently holds a Conditional Use Permit for property located at the same property to allow a single wide manufactured home to be located in an area currently zoned as --SF-7" Single Family Residential: and

WHEREAS, pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop. Texas, a public notice has been given, and a public hearing was held on February 24. 2005 by the Bastrop Planning & Zoning Commission regarding the request for a Conditional Use Permit by the Applicants and at that time, the Commission recommended approval: and

WHEREAS, pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop. Texas. a public notice has been given, and a public hearing was held on March 8. 2005 by the City Council regarding the request for a Conditional Use Permit by the Applicants: and

WHEREAS, the City Council finds that it is in the public interest to approve the requested Conditional Use Permit to permit a manufactured home to be located at 708 Linden Street in an area zoned as "SF-7" Single Family Residential. subject to the conditions noted herein.

NOW, THEREFORE_ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:

Part 1: The Conditional Use Permit requested by Crystal Stark, as Owner of the Property, to allow a doublewide manufactured home on property in an area zoned "SF-7" Single Family Residential at 708 Linden Street on 0.475 + acres located out of Farm Lot 7 East of Main Street, is hereby approved.

Part 2: This ordinance shall take effect upon passage and in accordance with the laws of the State of Texas.

READ and Acknowledged on First Reading on the 8th day of March 2005.
READ and Adopted on Second Reading on the 22nd day of March 2005.
