AN ORDINANCE DENYING A REQUEST FOR A CONDITIONAL USE PERMIT
TO ALLOW A PRIVATE STABLE FOR HORSES TO BE LOCATED AT 2303 PECAN STREET
FOR A 1.00 ± ACRE TRACT LOCATED OUT OF FARM LOT 11 EAST OF
MAIN STREET IN AN AREA ZONED "SF-7" - SINGLE FAMILY RESIDENTIAL
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Joe and Vernetta Williams. Owners of the
Property in question, (the "Applicants") filed a request
for a Conditional Use Permit for property located at 2303 Pecan Street,
to allow a private stable for horses to be located in an area currently
zoned as --SF-7" Single Family Residential: and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given and a public hearing was held
on February 24, 2005 by the Bastrop Planning & Zoning Commission
regarding the request for a Conditional Use Permit by the Applicants
and at that time, the Commission recommended denial: and
WHEREAS, pursuant
to Section 10 of the Zoning Ordinance of the City of Bastrop, Texas,
a public notice has been given, and a public hearing was held on March
8. 2005 by the City Council regarding the request for a Conditional
Use Permit by the Applicants. and
WHEREAS,
the City Council finds that it is in the public interest to deny the
requested Conditional Use Permit to permit a private stable for horses
to be located at 2303 Pecan Street in an area zoned as SF-F Single
Family Residential.
NOW. THEREFORE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP TEXAS:
Part 1: The Conditional
Use Permit requested by Joe and Vernetta Williams, as Owners of the
Property, to allow a private stable for horses on property in an area
zoned "SF-7" Single Family Residential at 2303 Pecan Street
on 1.00 ± acres located out of Farm Lot 1 l East of Main Street,
is hereby denied.
Part 2: This ordinance shall take effect upon passage and in accordance
with the laws of the State of Texas.
READ and DENIED on First Reading on the 8th day of March 2005.
READ and DENIED on Second Reading on the 22nd day of March 2005.
