AN ORDINANCE AMENDING BASTROP'S RIGHT-OF-WAY MUNICIPAL
TELECOMMUNICATION LINE RATES, AS PER ACTION OF THE PUBLIC UTILITY
COMMISSION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, in accordance with the March 16, 2004 notification
from the Texas Public Utility Commission the City to the City of Bastrop,
the City is hereby authorized to increase the City's maximum access
telecommunication line, as per Chapter 283 of the Local Government
Code; and
WHEREAS,
due to the effects of inflation on the operation of the rights-of
way-and access to telecommunication lines of the City, the City of
Bastrop desires to avail itself of the authority granted by the Local
Government Code and the Public Utility Commissions Order of March
16, 2004.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP,TEXAS:
PART 1:
That the Bastrop City Code Of Ordinances, shall be amended to reflect
an adjustment in the City's maximum telecommunication access line
rate for the year 2004, by an increase of 1.154% in the existing rate.
PART 2:
That all ordinances, resolutions and orders heretofore passed, adopted
and made, or any part of the same, affecting rates and charges for
telecommunications right-of-way access line rates, which are in conflict
with this Ordinance, shall be, and the same are hereby, in all things
repealed to the extent that the same conflict with this Ordinance,
or with the laws of the State of Texas.
PART 3:
This Ordinance shall take effect upon the date of final passage noted
below, or when all applicable publication requirements, if any, are
satisfied in accordance with the City's Charter, Code of Ordinances,
and the laws of State of Texas.
