ORDINANCE NO. 2004-12


AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS, REPEALING SECTION 10.406(a)(10) OF THE CODE OF ORDINANCES OF THE CITY OF BASTROP, TEXAS RELATING TO THE SCHOOL SPEED ZONE ON OLD AUSTIN HIGHWAY, AND ADOPTING A NEW SCHOOL SPEED ZONE ON OLD AUSTIN HIGHWAY AS PROVIDED HEREIN; PROVIDING A CONFLICT CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, the existing school speed zone on Old Austin Highway has been reevaluated in light of the recent construction on the street and in accordance with the engineer's traffic study on file with the City Secretary; and

WHEREAS, the City Council of the City of Bastrop, Texas, hereby finds it necessary and proper and in the best interests of the citizens of Bastrop to establish a new speed zone along Old Austin Highway in light the changes to the road and in accordance with the engineer's study.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS, THAT:

SECTION 1: Section 10.406(a)(10) of the Code of Ordinances of the City of Bastrop is hereby repealed in its entirety.

SECTION 2: New Sections 10.406(c) relating to the establishment of school speed zones on Old Austin Highway is hereby adopted and shall read as follows:

(c) The city hereby designates school zones on the following streets. A maximum speed of 25 miles per hour is established for the following two periods (i) beginning 45 minutes before the start of school and ending 30 minutes after the start of school; and (ii) beginning 45 minutes before the end of school and ending 30 minutes after the end of school, whenever school is in session:

(1)Beginning approximately .492 miles West of the intersection of Old Austin Hwy and Loop 150 (Approximately Sta. 25+00 OAH Plans), and ending approximately .662 miles West of intersection of Old Austin Hwy and Loop 150 (Approximately Sta. 16+00 OAH Plans);

(2) Beginning approximately. 837 miles West of intersection of Old Austin Hwy and Loop 150 (Approximately Sta. 6+80 OAH Plans), and ending .956 miles West of intersection of OAH and Loop 150 (Approximately Sta. 0+50 OAH Plans).


SECTION 3: This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Bastrop, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded.

SECTION 4: If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable.

SECTION 5: The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Bastrop.
