ORDINANCE NO. 2004-11


AN ORDINANCE AMENDING SECTION 10.503 OF THE CITY OF BASTROP CODE OF ORDINANCES RELATING TO "SPEED LIMITS - SPECIAL SCHEDULES" TO ESTABLISH A SPEED LIMIT OF 35 MILES PER HOUR FOR THE PORTION OF OLD AUSTIN HIGHWAY FROM LOOP 150 TO THE TEXAS DEPARTMENT OF TRANSPORTATION RIGHT-OF-WAY FOR STATE HIGHWAY 71; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the City Council of the City of Bastrop recognizes the need to provide safe conditions for the those traveling on public streets within the city; and

WHEREAS, pursuant to a study on file with the City Secretary, the City Council finds that it is appropriate to establish a speed limit of 35 miles per hour for the portion of Old Austin Highway from Loop 150 to the Texas Department of Transportation right-of-way for State Highway 71; and

WHEREAS, Section 10.503 of the Bastrop Code of Ordinances authorizes the City Secretary to prepare and maintain a special schedule reflecting speed limits within the City of Bastrop which vary from the general speed limit noted in Section 10.502 of the City Code; and

WHEREAS, the City has determined that the portion of Old Austin Highway from Loop 150 to the Texas Department of Transportation right-of-way for State Highway 71 should be added to the areas with special speeds pursuant to the findings of the engineer's study on file with the City Secretary.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:

SECTION 1: That the Special Schedule reference in Section 10.503 of the City of Bastrop Code of Ordinances, which schedule is kept on file in the office of the City Secretary, shall be, and it is hereby, amended to establish a speed limit of 35 miles per hour for the portion of Old Austin Highway from Loop 150 to the Texas Department of Transportation right-of-way for State Highway 71.

SECTION 2: The amended Special Schedule shall be kept on file in the office of the City Secretary.

SECTION 3: This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Bastrop, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded.

SECTION 4: If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable.

SECTION 5: The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Bastrop.
