AN ORDINANCE GRANTING
A REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW A OPERATION OF A TRUCK
RENTAL AND RETAIL FACILITY TO BE LOCATED ON A 5.137 ACRE TRACT ON
THE NORTH FRONTAGE OF STATE HIGHWAY 71 EAST APPROXIMATELY 200 FEET
WEST OF THE INTERSECTION WITH INDUSTRIAL IN AN AREA ZONED "I-P"
"INDUSTRIAL PARK" (AND TO BE RE-ZONED TO "C-2"
"HEAVY COMMERCIAL ON EVEN DATE HEREWITH); AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Don A. and Martha Fries (the "Applicants")
filed a request for a Conditional Use Permit for a 5.137-acre tract
located generally on the north frontage of State Highway 71 East approximately
200 feet west of the intersection with Industrial; and
WHEREAS,
Applicants have also simultaneously requested that the property be
re-zoned from "I-P" "Industrial park" to "C-2"
"Commercial (Heavy)"; and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on April 10, 2003 by the Planning & Zoning Commission regarding
the request for a Conditional Use Permit by the Applicant; and
WHEREAS,
the Planning & Zoning Commission recommended approval of the application;
and
WHEREAS,
pursuant to Section 10 of the Zoning Ordinance of the City of Bastrop,
Texas, a public notice has been given, and a public hearing was held
on April 22, 2003 by the City Council regarding the request for a
Conditional Use Permit by the Applicant; and
WHEREAS,
the City Council finds that it is in the public interest to approve
the requested Conditional Use Permit to permit the property to be
used as a truck rental/retail facility in an area zoned as Industrial
park (I-P).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BASTROP, TEXAS:
Part 1: The Conditional Use Permit requested
by Don A. and Martha Fries, owners of a 5.137-acre tract located generally
on the north frontage of State Highway 71 East approximately 200 feet
west of the intersection with Industrial, to allow for the use of
the property as a truck rental/retail facility, is hereby approved.
Part 2: This ordinance shall take effect upon
passage and in accordance with the laws of the State of Texas.
READ and APPROVED on First Reading on the 22nd day of April 2003.
READ and ADOPTED on Second Reading on the 13th day of May 2003.
