AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS ADDING SECTION 3.1609
TO THE CODE OF ORDINANCES TO ADOPT A CONSTRUCTION MANUAL BY REFERENCE;
AMENDING THE CITY'S SUBDIVISION REGULATIONS (ORDINANCE NO. 99-23)
TO ADD SECTION 3.50 ADOPTING A DEVELOPMENT MANUAL BY REFERENCE; AND
AMENDING THE CITY'S ZONING ORDINANCE (ORDINANCE NO. 99-37) TO ADD
SECTION 6.1 TO ADOPT A DEVELOPMENT MANUAL BY REFERENCE; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City has prepared a "Construction
Manual" that describes street construction standards in great
detail and also includes detailed design drawings and specifications;
and
WHEREAS,
the City's Director of Planning has prepared a "Development Manual"
that will assist applicants in complying with various technical and
policy provisions of the City's Subdivision and Zoning Regulations
and that is anticipated to be more detailed than would be desired
in an ordinance; and
WHEREAS,
the City desires to apprise the public of the existence of these Manuals
and to make them enforceable on a uniform basis; and
WHEREAS,
the City's Planning & Zoning Commission considered these Code
and Ordinance changes at their regular meeting on April 10, 2003 and
recommended their approval by the City Council.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:
Part 1:
The facts and recitations contained in the preamble of this ordinance
are hereby found and declared to be true and correct, and are incorporated
by reference herein and expressly made a part hereof, as if copied
verbatim.
Part 2:
Section 3.1609 "Construction Manual" is hereby added to
the City of Bastrop Code of Ordinances as follows:
Sec. 3.1609 Construction Manual
The Construction Manual
prepared by the City's Planning Department is hereby adopted by reference
as if set forth in full. The Construction Manual shall contain specifications
necessary to construct public projects. The Construction Manual may
be amended administratively from time to time by the Director of the
City's Planning Department following published notice in the Bastrop
Advertiser of the intent to amend the Construction Manual and a 30-day
public comment period.
Part 3: Section 3.50 "Development Manual"
is hereby added to the City's Subdivision Regulations (Ordinance No.
99-23) as follows:
Sec. 3.50 Development
Manual
The Development Manual
prepared by the City's Planning Department is hereby adopted by reference
as if set forth in full. The Development Manual shall contain specifications
and policy guidance necessary to comply with the City's Subdivision
and Zoning Ordinances. The Development Manual may be amended administratively
from time to time by the Director of the City's Planning Department
following published notice in the Bastrop Advertiser of the
intent to amend the Development Manual and a 30-day public comment
period.
Part 4:
Section 6.1 "Development Manual" is hereby added to the
City's Zoning Ordinance (Ordinance No. 99-37) as follows:
Sec. 6.1 Development Manual
The Development Manual prepared by the City's Planning Department
is hereby adopted by reference as if set forth in full. The Development
Manual shall contain specifications and policy guidance necessary
to comply with the City's Subdivision and Zoning Ordinances. The Development
Manual may be amended administratively from time to time by the Director
of the City's Planning Department following published notice in the
Bastrop Advertiser of the intent to amend the Development Manual
and a 30-day public comment period.
Part 5: The City Manager and City Secretary
are hereby authorized and directed to make the necessary changes to
all records of the City of Bastrop to reflect this amendment.
Part 6: All
ordinances and resolutions, or parts of ordinances and resolutions,
in conflict with this Ordinance are hereby repealed, and are no longer
of any force and effect. If any provision of this ordinance or application
thereof to any person or circumstance shall be held invalid, such
invalidity shall not affect the other provisions, or application thereof,
of
this ordinance which can be given effect without the invalid provision
or application, and to this end the provisions of this ordinance are
hereby declared to be severable.
Part 7: This
Ordinance shall become effective in accordance with the City Charter
and the laws of the State of Texas.
