AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF BASTROP, TEXAS AMENDING SECTION 8.4 OF
CHAPTER 12 PLANNING & ZONING, EXHIBIT "A" OF THE CITY'S
CODE OF ORDINANCES CHANGING THE MEETING DATE OF THE PLANNING AND ZONING
COMMISSION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Bastrop's Planning and Zoning Commission
currently meets on the second Thursday of each month, and
WHEREAS,
a change in the meeting date of the Planning and Zoning Commission
is necessary to ensure timely consideration of its recommendations
by the City Council; and
WHEREAS,
at its August 12, 2004 meeting, the Planning & Zoning Commission
considered changing their regularly scheduled meeting date to the
last Thursday of each month and recommended such change be made; and
WHEREAS,
the Planning and Zoning Commission requests the City Council consider
their recommendation and approve the change in the regularly scheduled
meeting date to the last Thursday of each month.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:
Part 1: The facts
and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct, and are incorporated by
reference herein and expressly made a part hereof, as if copied verbatim.
Part 2: Section
8.4 of Chapter 12: Planning & Zoning, Exhibit "A" of
the City's Code of Ordinances is amended to read as follows:
8.4 MEETINGS:
The Planning and Zoning
Commission shall meet on the last Thursday of each month in the City
Hall or other specified locations as may be designated by the Chairman
or Vice Chairman, in the absence of the chairman, and at such intervals
as may be necessary to orderly and properly transact the business
of the Commission.
Part 3: The City Manager and City Secretary are hereby authorized
and directed to make the necessary changes to all records of the City
of Bastrop to reflect this amendment.
Part 4: All ordinances
and resolutions, or parts of ordinances and resolutions, in conflict
with this Ordinance are hereby repealed, and are no longer of any
force and effect. If any provision of this ordinance or application
thereof to any person or circumstance shall be held invalid, such
invalidity shall not affect the other provisions, or application thereof,
of this ordinance which can be given effect without the invalid provision
or application, and to this end the provisions of this ordinance are
hereby declared to be severable.
Part 5: This Ordinance
shall become effective in accordance with the City Charter and the
laws of the State of Texas.
READ and APPROVED on First Reading on the 14th day of September 2004.
READ and ADOPTED on Second Reading on the 28th day of September 2004.
