ORDINANCE NO. 2004-35

AN ORDINANCE GRANTING A REQUEST TO REZONE FROM "MF1"- MULTI FAMILY TO "SF 3" - SINGLE FAMILY RESIDENTIAL FOR A 2.622 +/- ACRE TRACT, WHICH IS LOCATED AT THE 1100 BLOCK OF PITT STREET, BUILDING BLOCK 132, BASTROP COUNTY, TEXAS AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS,
Carlton and Renia Harris, Mona Johnson-Williams, and Michael and Debra Reynolds (hereinafter referred to as "Applicants") submitted a request to rezone, from zoning designation "MY-l" Multi-Family to zoning designation "SF 3" - Single Family Residential, a 2.622 +/-acre tract of land, consisting of three lots of 0.874 +/-acre tract of land where Lot I is a 0.874 +/-acre tract of land out of Building Block 132 owned by Carlton and Renia Harris, Lot 2 is a 0.874 +/-acre tract of land out of Building Block 132 owned by Mona Johnson-Williams, and Lot 3 is a 0.874 +/-acre tract of land out of Building Block owned by Michael and Debra Reynolds, located at the 1100 block of Pitt Street, Building Block 132 in Bastrop, Texas (hereinafter referred to as "the Property" and more particularly described in the survey accompanying the application); and

WHEREAS, the intended use of the Property is as single family residences; and

WHEREAS, pursuant to Section 10.4 of the City's Zoning Ordinance, notice of the rezoning request was given to all property owners located within two hundred feet of the Property, and the Planning and Zoning Commission of the City of Bastrop held a public hearing on the Applicants' rezoning request September 9, 2004; and

WHEREAS, after notice and hearing, the Planning and Zoning Commission has recommended approval of the Applicants' request for rezoning; and

WHEREAS, pursuant to Section 10.4 of the City's Zoning Ordinance, notice of the rezoning request was given as required by the ordinance, and the City Council of the City of Bastrop held a public hearing on the Applicants' rezoning request on September 14, 2004 to consider the request; and

WHEREAS, City Council finds that it is in the public interest to approve the Applicants' rezoning request.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:

Part 1: The tract owned by the Applicants, said Property being more particularly described as a 2.622 +/-acre tract of land located at the 1100 block of Pitt Street, Building Block 132 in Bastrop, Texas is hereby rezoned to "SF 3" -Single Family Residential.

Part 2: This ordinance shall take effect upon passage and in accordance with the laws of the State of Texas.

READ and APPROVED on First Reading on the 14th day of September 2004. READ and ADOPTED on Second Reading on the 28th day of September 2004.
