AN ORDINANCE AMENDING
OF THE BASTROP CITY CODE CHAPTER 10 TRAFFIC CONTROL, ARTICLE 10.800
SKATEBOARDING AND SKATES; CONTAINING A PENALTY CLAUSE; CONTAINING
A REPEALER CLAUSE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City has determined that the following regulation
of skateboarding and skating in public areas is necessary in order
to protect public health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF BASTROP, TEXAS:
Part
1. Article 10.800 of the City Code is hereby amended as follows:
ART. 10.800 Skateboards and Skates
A. Skateboard
riding and skating is prohibited in all public areas within the boundaries
of the Central Business District in the City of Bastrop, Texas, including
all sidewalks, streets, drainage ways, drainage channels, drainage
outfalls, and/or other public areas in order to reduce the risk to
riders, pedestrians, and other traffic.
B.
Skateboard riding, skating, and bicycling are prohibited in all drainage
ways, drainage channels, drainage outfalls within the city limits,
except in such areas specifically approved and designated by the City
for such use.
C.
Skateboard riding, skating, and bicycling are prohibited in and on
all City owned and operated tennis courts and tennis facilities located
on City property, including those located in City Parks.
Part 2. If any section
or part of this Ordinance is held to be invalid or unconstitutional
by a court of competent jurisdiction, that holding shall not invalidate
or impair the validity, force or effect of any other section or part
of this Ordinance or Code of Ordinances, City of Bastrop, Texas.
Part 3. This Ordinance supersedes and repeals all Ordinances
or parts of Ordinances, if any, in conflict herewith; however, such
present Ordinances shall remain in full force and effect until the
effective date of this Ordinance.
Part 4. This Ordinance
shall take effect upon the date of final passage noted below, or when
all applicable publication requirements, if any, are satisfied in
accordance with the City's Charter, Code of Ordinances, and the laws
of State of Texas.
READ and APPROVED on First
Reading on the 25th day of February 2003. READ and ADOPTED on Second
Reading on the 11th day of March, 2003.
