ORDINANCE NO. 2002-35

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS AMENDING SECTION 10.609 OF THE CODE OF ORDINANCES TO ESTABLISH NO PARKING ZONES ON BOTH SIDES OF LOOP 150 (CHESTNUT STREET) FROM THE INTERSECTION OF LOOP 150 (CHESTNUT STREET) AND HIGHWAY 71, TO THE INTERSECTION OF LOOP 150 (CHESTNUT STREET) AND ALLEY "B"; DIRECTING THAT SIGNS BE ERECTED TO REFLECT THIS CHANGE; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS
, the City Council of the City of Bastrop recognizes the need to provide safe conditions for those traveling on public streets within the City, and

WHEREAS, pursuant to study and input from the Texas Department of Transportation concerning safety issues related to the parking of vehicles on and along the street and public right-of-ways of Loop 150 (also known as Chestnut Street), the City Council desires to prohibit parking of vehicles on and along the street and public right-of-ways of both sides of Loop 150 (Chestnut Street) from the intersection of Loop 150 and Highway 71, to the intersection of Loop 150 and Alley "B."

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT SECTION 10.609 BE AMENDED TO INCLUDE THE FOLLOWING:

SECTION 1:
Section 10.609 "No Parking on Certain City Streets" of the Code of Ordinances of the City of Bastrop is hereby amended as follows:

SEC. 10.609 No Parking on Certain City Streets

No person shall park a motor vehicle, as that term is defined in the Texas Transportation Code, Section 501.002(14) in the following areas:

1. - 7. (No Change)

8. On and along the street and public right-of-ways of both sides of Loop 150, also known as Chestnut Street, from the intersection of Loop 150 and Highway 71, to the intersection of Loop 150 and Alley "B," save and except for designated parallel parking spaces along both sides of Chestnut Street as may be approved by both the City and the Texas
Department of Transportation, with such parallel parking spaces to be located solely east of the Colorado River Bridge and west of Alley "B "

SECTION 2: The City Manager shall cause "No Parking" signs to be erected at such locations necessary to make this change in the parking zone applicable to the above referenced portion(s) of Loop 150 (Chestnut Street).

SECTION 3:The City Manager and City Secretary are hereby authorized and directed to make necessary changes to all records of the City of Bastrop to reflect this amendment.

SECTION 4: This Ordinance becomes effective in accordance with the terms and provisions of the City Charter and State law.

READ and Acknowledged on First Reading on the 26th day of November, 2002. READ and Adopted on Second Reading on the 10th day of December, 2002.
