AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS
AMENDING, UPDATING AND REPLACING PORTIONS OF CHAPTER 3, THE "BUILDING
AND CONSTRUCTION" CHAPTER OF THE CODE OF ORDINANCES OF THE CITY
OF BASTROP, TEXAS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the Legislature of the State of Texas amended Chapter
214, Local Government Code, by adding Subchapter G, requiring all
Texas municipalities to adopt the new 2000 International Residential
Code, 2000 International Energy Code and the 1999 National Electrical
Code, and to enforce these requirements by January 1, 2002.
WHEREAS, the City of Bastrop desires to amend and replace portions
of the existing building code, including all associated codes adopted
on or before October 29, 1996.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF BASTROP TEXAS, THAT:
PART 1: CHAPTER 3 OF THE CITY CODE OF ORDINANCES IS
HEREBY AMENDED AS PROVIDED BELOW:
ARTICLE 3.100 ADOPTION OF THE INTERNATIONAL BUILDING
CODES
SECTION 3.101 ADOPTION OF CODES
(a) Codes. The following code editions and
appendixes, as published by the International Code Council, Inc.,
Southern Building Code Congress, and National Fire Protection Association,
shall be and are hereby adopted by reference as though they were copied
herein, fully, save and except such portions as are hereinafter deleted,
modified, or amended:

(b) Statutes. The following statutes of the State of Texas
shall be and are hereby adopted by reference as though they were fully
copied herein, together with such amendments to same as may be made
from time to time:
The State of Texas "Plumbing License Law,"
as set out in Article 6243-101 of Texas Civil Statutes, in its entirety,
as amended.
The Texas Natural Resource Conversation Commission (TNRCC) 30 Texas
Administrative Code Chapter 285 on-site sewage facilities with the
1997 Texas On-Site Sewage Facilities Rules.
(c)Effect of prior and subsequent codes. All portions of the
existing code shall remain in effect unless specifically amended in
this or subsequent sections.
PART 2: That should any section, clause or provision
of this ordinance be declared by a court of competent jurisdiction
to be invalid, the same shall not affect the validity of this ordinance
or any other ordinance of the City as a whole or any part thereof,
other than the part so declared to be invalid.
PART 3: This Ordinance shall take effect upon passage
and approval, and as provided by State law.
