AN ORDINANCE GRANTING
A REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW AN ACCESSORY DWELLING
TO BE LOCATED AT 2017 MAIN STREET, BASTROP, TEXAS, IN AN AREA ZONED
SF-7, "SINGLE FAMILY RESIDENTIAL", AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, David and
Mirella Spalding (the "Applicants") filed a request for
a Conditional Use Permit for their property located at 2017 Main Street
("the Property") in an area zoned SF-7 (Single Family Residential)
to allow a 720 square foot accessory dwelling to be placed on the
Property to be used as a guesthouse, and
WHEREAS, pursuant
to Section 10 of the Zoning Ordinance of the City of Bastrop, Texas,
a public notice has been given, and a public hearing was held on August
8, 2002 by the Planning & Zoning Commission regarding the request
for a Conditional Use Permit by the Applicant; and
WHEREAS, the Planning
and Zoning Commission recommended approval of the application, and
WHEREAS, pursuant to Section 10 of the Zoning Ordinance of
the City of Bastrop, Texas, a public notice has been given, and a
public hearing was held on August 13, 2002 by the City Council regarding
the request for a Conditional Use Permit by the Applicants; and
WHEREAS, the City
Council finds that it is in the public interest to approve the requested
Conditional Use Permit to permit a 720 square foot accessory dwelling
to be located on the property in an area zoned as Single Family Residential
(SF-7),
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF BASTROP, TEXAS:
Part 1: The Conditional
Use Permit requested by David and Mirella Spalding, owners of the
Property located at 2017 Main Street, Bastrop, Texas, to allow the
placement of a 720 square foot accessory dwelling to be used as a
guesthouse on the Property in an area zoned as Single Family Residential
(SF-7), is hereby approved.
Part 2: This ordinance
shall take effect upon passage and in accordance with the laws of
the State of Texas.
READ and APPROVED on First
Reading on the 13th day of August 2002. READ and ADOPTED on Second
Reading on the 27th day of August 2002.
