AN ORDINANCE GRANTING
A REQUEST TO REZONE FROM "SF-7 - SINGLE FAMILY RESIDENTIAL"
TO "MF - 1 - MULTI-FAMILY" FOR A 1.0420 +/- ACRE TRACT OF
LAND OUT OF FARM LOT 7 WEST OF MAIN STREET WHICH IS LOCATED AT 610
LINDEN ST., BASTROP, TEXAS, OWNED BY JACK AND LILLIAN QUON; AND ESTABLISHING
AN EFFECTIVE DATE.
WHEREAS, Gregory O'Neal, as authorized representative
for Jack and Lillian Quon, (hereinafter referred to as "Applicant")
submitted a request to rezone, from zoning designation "SF-7
- SINGLE FAMILY RESIDENTIAL" to zoning designation "MF-1-
MULTI-FAMILY," a 1.0420 +/-acre tract out of Farm Lot 7 West
of Main Street, property located at 610 Linden Street in Bastrop,
Texas, hereinafter referred to as "the Property" and described
in a diagram at Exhibit "A" attached hereto.
WHEREAS,
the intended use of the Property is for a multi-family project; and
WHEREAS,
pursuant to Section 10.4 of the City's Zoning Ordinance, notice of
the rezoning request was given to all property owners located within
two hundred feet of the Property, and the Planning and Zoning Commission
of the City of Bastrop held a public hearing on the Applicant's rezoning
request on April 28, 2005, and
WHEREAS,
after notice and hearing, the Planning and Zoning Commission has recommended
that the Applicant's request to rezone the Property to "MF-1
MULTI-FAMILY" be approved, and
WHEREAS,
pursuant to Section 10.4 of the City's Zoning Ordinance, notice of
the rezoning request was given as required by the ordinance, and the
City Council of the City of Bastrop held a public hearing on the Applicant's
rezoning request on May 10, 2005 to consider the request; and
WHEREAS,
City Council finds that it is in the public interest to approve rezoning
of the Property to "M&1 MULTI-FAMILY."
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP THAT:
Part 1: The tract
owned by Jack and Lillian Quon, said Property being more particularly
described as a 1.0420 +/-acre tract out of Farm Lot 7 West of Main
Street, located at 610 Linden Street in Bastrop, Texas, is hereby
rezoned from designation "SF-7 - Single Family Residential"
to zoning designation "MF-1 MULTI-FAMILY.",
Part 2: This Ordinance
shall take effect upon the date of final passage noted below, or when
all applicable publication requirements, if any, are satisfied in
accordance with the City's Charter, Code of Ordinances, and the laws
of State of Texas.
READ and Acknowledged on First Reading on the 10th day of May 2005.
READ and Adopted on Second Reading on the 24th day of May 2005.
