AN ORDINANCE GRANTING A REQUEST FOR A CONDITIONAL USE PERMITTO
ALLOW A VETERINARIAN HOSPITAL WITH OUTSIDE ANIMAL PENS TO BE LOCATED
AT 444 HIGHWAY 71 - WEST ON PROPERTY AT LOT 1 OF SETTLEMENT ON THE COLORADO
IN AN AREA ZONED Ci- COMMERCIAL AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Greg and Connie Maynard, Owners of the Property
in question, (the --Applicants") filed a request for a Conditional
Use Permit for property located at 444 Highway 71 - West, to allow a
veterinarian hospital with outside animal pens, known as Crossroads
Animal Hospital, to be located in an area currently being annexed into
the City limits and zoned as C-1 Commercial; and
WHEREAS, pursuant to Section 10 of the Zoning Ordinance
of the City of Bastrop, Texas, a public notice has been given, and
a public hearing was held on June 10, 2004 by the Bastrop Planning
& Zoning Commission regarding the request for a Conditional Use
Permit by the Applicants and at that time, the Commission recommended
approval, with the conditions noted herein below; and
WHEREAS, pursuant to Section 10 of the Zoning Ordinance
of the City of Bastrop, Texas, a public notice has been given, and
a public hearing was held on June 22. 2004 by the City_ Council regarding
the request for a Conditional Use Permit by the Applicants; and
WHEREAS, the City Council finds that it is in the
public interest to approve the requested Conditional Use Permit to
permit the veterinarian hospital with outside animal pens to operate
on a lot located at 444 Highway 71 -West, in an area zoned as "C-1"
Commercial, subject to the conditions noted herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BASTROP, TEXAS:
Part 1:. The Conditional Use Permit requested by Greg and
Connie Maynard, as Owners of the Property, to allow the operation
of a veterinarian hospital with outside animal pens on property zoned
"C-l" Commercial at 444 State Highway 71 - West, is hereby
approved, subject to the following special conditions:
1. The outdoor animal pens are to be retained at the current level
and character of usage and not be expanded upon;
2. Only dogs are to be allowed in the rear chain link enclosed pen
- no larger animals are allowed; and
3. The covered pen area currently used for larger animals, primarily
horses, may not be expanded upon; and
4. The owners shall take all reasonable steps to control odors emanating
from the property at all times.
Part 2: This ordinance shall take effect upon passage and in
accordance with the laws of the State of Texas.
