AN ORDINANCE GRANTING A REQUEST FOR A CONDITIONAL USE PERMIT
TO ALLOW A MINI WAREHOUSE, SELF STORAGE AND BOAT AND RV STORAGE TO BE
LOCATED IN THE 800 BLOCK OF HIGHWAY 71 - WEST FOR AN 8.683 + ACRE TRACT
OUT OF THE NANCY BLAKEY SURVEY LOCATED ON HIGHWAY 71 WEST IN AN AREA
ZONED "C-2" - COMMERCIAL - 2 AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Robert E. Duff, Owner of the Property in question,
(the "Applicant") filed a request for a Conditional Use Permit
for property located in the 800 Block of Highway 71 West, to allow self
storage/boat and RV storage (mini warehouse), to be located in an area
currently being annexed into the City limits and rezoned as "C-2"
Commercial -2,and
WHEREAS, pursuant to Section 10 of the Zoning Ordinance
of the City of Bastrop, Texas, a public notice has been given, and a
public hearing was held on June 10, 2004 by the Bastrop Planning &
Zoning Commission regarding the request for a Conditional Use Permit
by the Applicant and at that time, the Commission recommended approval,
with the conditions noted herein below; and
WHEREAS, pursuant to Section 10 of the Zoning Ordinance
of the City of Bastrop, Texas, a public notice has been given, and
a public hearing was held on June 22, 2004 by the City Council regarding
the request for a Conditional Use Permit by the Applicant; and
WHEREAS, the City Council finds that it is in the
public interest to approve the requested Conditional Use Permit to
permit the self-storage/boat and RV storage (mini warehouse) to operate
on a lot located in the 800 block of Highway 71 West, in an area rezoned
as "C-2" Commercial - 2, subject to the conditions noted
herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BASTROP, TEXAS:
Part 1: The Conditional Use Permit requested by Robert E. Duff,
as Owner of the Property, to allow the operation of a self-storage/boat
and RV storage (mini warehouse) on property rezoned "C-2"
Commercial-2 in the 800 block of State Highway 71 West in the Nancy
Blakey tract located on Highway 71 West, is hereby approved, subject
to the following special conditions:
1. The landscape plan must exceed the minimum amount of landscaping
required by City code;
2. Provision of vegetative buffering of the site along the perimeters
of the property, especially the storage buildings along Highway 1:
3. An effective tree and vegetation preservation plan for the detention
pond area and any other applicable areas,
4. Effective high quality fencing,
5. Prohibition on the use of storage units for offices or any business
activity other than storage;
6. Prohibition of use of any temporary uses or structures (awnings,
etc.); and
Vehicle (moving truck) rentals and location of outdoor storage must
be located to the rear (northern portion) of the property.
8. Built as represented in presentations before Council and Planning
and Zoning Commission.
Part 2: This ordinance shall take effect upon passage and
in accordance with the laws of the State of Texas.
