ORDINANCE NO. 2004-14
AN ORDINANCE AMENDING THE BASTROP CITY CODE CHAPTER 10, TRAFFIC CONTROL, ARTICLE 10.400, ET SEQ. RELATED TO THE LOCATION OF STOP SIGNS WITHIN THE CITY; REPEALING CONFLICTING PROVISONS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the City has determined that the intersections noted herein are hazardous and that traffic at these intersections should be controlled by stop signs in order to protect public health, safety, and welfare.


NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:


PART 1: That “Schedule III: Stop Signs” in Section 10.404, Chapter 10 of the Bastrop City Code, which schedule is kept on file in the office of the City Secretary, shall be, and is hereby amended to add the following intersections to be controlled by stop signs as set forth in Exhibit “A,” attached hereto, and which is incorporated herein by reference as if set forth in full.

PART 2: This amendment to “Schedule III: Stop Signs,” referenced in Section 10.404 of Chapter 10 of the Bastrop City Code, supercedes any contrary provisions previously adopted by the Council. Any provisions of “Schedule III: Stop Signs” that are not amended hereby shall remain in full force and effect. This Ordinance does not rescind the authority for or effectiveness of any existing one-way stops currently located within the City that have been previously approved by the City Council.

PART 3: Copies of the amended “Schedule III: Stop Signs” shall be kept on file in the office of the City Secretary.

PART 4: If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable.

PART 5: This Ordinance shall take effect upon passage and approval, in accordance with the laws of the State of Texas.

EXHIBIT “A”


Section 10.404 “Schedule III: Stop Signs” in Chapter 10 of the Bastrop City Code is amended to add the following intersections to be controlled by stop signs as follows:

(1) Home Depot Way and Highway 304;
(2) Home Depot Way and Hunters Crossing Blvd.;
(3) Hunters Crossing Blvd. and Highway 71;
(4) Hunters Crossing Blvd (north bound traffic) and Home Depot Way;
(5) Hunters Crossing Blvd (south bound traffic) and Home Depot Way;
(6) Hunters Crossing Blvd. and Hunters Point Drive;
(7) Hunters Point Drive (east bound traffic) and Hunter Crossing Blvd.;
(8) Hunters Point Drive (west bound traffic) and Hunters Crossing Blvd.;
(9) Peccary Pass and Pheasant Trail;
(10) Peccary Pass and Hunters Point Drive.
