AN ORDINANCE GRANTING
A REQUEST TO REZONE FROM "MF-2" -
MULTI FAMILY AND "C-29'- COMMERCIAL TO "C-19'- COMMERCIAL
AND "GR" - GENERAL RETAIL, FOR A 26.537 ± ACRE TRACT
OF LAND
OWNED BY LESLIE L. APPELT, WHICH IS GENERALLY KNOWN AS PINE
FOREST, PHASE II, UNIT 6, RESERVE "A," LOCATED ON THE SOUTH
FRONTAGE OF STATE HIGHWAY 71 BETWEEN TAHITIAN DRIVE AND
JACKSON, BASTROP COUNTY, TEXAS; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, Leslie L. Appelt (hereinafter referred to
as "Applicant") submitted a request to rezone, from zoning
designation "MF-2" - Multi Family and "C-2" -
Commercial to zoning designation "GR" - General Retail and
"C-1" - Commercial, a 26.537 ± acre tract known as
Pine Forest, Phase II, Unit 6, Reserve "A" located on the
south frontage of State Highway 71 between Tahitian Drive and Jackson,
in Bastrop County, Texas, and legally described as:
The Lakeside Medical Complex Development, "the Property"
and more particularly described in the Master Plan attached hereto
as Exhibit "A"; and
WHEREAS, the intended use of the Property is a master
planned development to be known as Lakeside Medical Complex and to
include a hospital and medical complex; and
WHEREAS, pursuant to Section 10.4 of the City's Zoning
Ordinance, notice of the rezoning request was given to all property
owners located within two hundred feet of the Property, and the Planning
and Zoning Commission of the City of Bastrop held a public hearing
on the Applicant's rezoning request on October 9, 2003; and
WHEREAS, after notice and hearing, the Planning and
Zoning Commission has recommended approval of the Applicant's request
for rezoning;
WHEREAS, pursuant to Section 10.4 of the City's Zoning
Ordinance, notice of the rezoning request was given as required by
the ordinance, and the City Council of the City of Bastrop held a
public meeting on the Applicant's rezoning request on October 14,
2003 to consider the request; and
WHEREAS, the City Council finds that it is in the
public interest to approve the Applicant's rezoning request.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE MY
OF BASTROP THAT:
Part 1:
The tract owned by the Applicant, said Property being more particularly
described as a 26.537 ± acre tract of land known as Reserve
"A" of Pine Forest, Unit 6, located on the south frontage
of State Highway 71 between Tahitian Drive and Jackson, in Bastrop,
Texas is hereby rezoned from "MF-2"- Multi Family and "C-2"
- Commercial to "GR" - General Retail and "C-I"
- Commercial.
Part 2:
This ordinance shall take effect upon passage and in accordance with
the laws of the State of Texas.

First Reading on the 14th day of October 2003.
READ and ADOPTED on Second Reading on the 28th day of October 2003.
