AN ORDINANCE AMENDING
THE BASTROP CITY CODE CHAPTER 10,
TRAFFIC CONTROL, ARTICLE 10.400, ET SEQ. RELATED TO THE LOCATION OF
FOUR-WAY STOP SIGNS, STOP SIGNS, AND YIELD SIGNS WITHIN THE CITY, AMENDING,
ARTICLE 10.500, SECTION 10.503, RELATED TO SPEED LIMITS; REPEALING CONFLICTING
PROVISONS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE,
WHEREAS, pursuant to a study of traffic patterns performed
by the Police Department the City has determined that the intersections
noted herein are hazardous and that traffic at these intersections should
be controlled by stop signs in order to protect public health, safety,
and welfare; and
WHEREAS,
pursuant to a study of traffic patterns performed by the Police Department
the City has determined that the streets noted herein may be hazardous
if proper speed is not maintained thereon and, thus, that traffic on
these streets should be controlled by a 20 MPH speed zone in order to
protect public health, safety, and welfare.
NOW, THEREFORE, BE
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:
PART 1: That "Schedule
II: Four-Way Stops" in Section 10.403(a), Chapter 10 of the Bastrop
City Code, which schedule is kept on file in the office of the City
Secretary, shall be, and is hereby, amended to add the following intersections
to be controlled by fourway stop signs as set forth in Exhibit "A,
" attached hereto, and which is incorporated herein by reference
as if set forth in full.
PART 2: That "Schedule
III: Stop Signs" in Section 10.404, Chapter 10 of the Bastrop City
Code, which schedule is kept on file in the office of the City Secretary,
shall be, and is hereby amended to add the following intersections to
be controlled by stop signs as set forth in Exhibit "B, "
attached hereto, and which is incorporated herein by reference as if
set forth in full.
PART 3: That "Schedule
IV: Yield Signs" in Section 10.405, Chapter 10 of the Bastrop City
Code, which schedule is kept on file in the office of the City Secretary,
shall be, and is hereby, amended to delete the following streets controlled
by yield signs as set forth in
Exhibit "C, " attached hereto, and which is incorporated herein
by reference as if set forth in full.
PART 4: That "Speed
Limits - Special Schedules" in Section 10.503, Chapter 10 of the
Bastrop City Code, which schedule is kept on file in the office of the
City Secretary, shall be, and is hereby, amended to add the following
streets to be controlled by 20 MPH Speed Zone signs as set forth in
Exhibit "D," attached hereto, and which is incorporated herein
by reference as if set forth in full.
PART 5. This amendment
to "Schedule II: Four-Way Stops," referenced in Section 10.403
of Chapter 10 of the Bastrop City Code, supercedes any contrary provisions
previously adopted by the Council. Any provisions of "Schedule
II: Four-Way Stops," that are not amended hereby shall remain in
full force and effect. This Ordinance does not rescind the authority
for or effectiveness of any existing four-way stops currently located
within the City that have been previously approved by the City Council.
PART 6. This amendment
to "Schedule III: Stop Signs," referenced in Section 10.404
of Chapter 10 of the Bastrop City Code, supercedes any contrary provisions
previously adopted by the Council. Any provisions of "Schedule
III: Stop Signs" that are not amended hereby shall remain in full
force and effect. This Ordinance does not rescind the authority for
or effectiveness of any existing one-way stops currently located within
the City that have been previously approved by the City Council.
PART 7. This amendment
to "Schedule IV: Yield Signs," referenced in Section 10.405
of Chapter 10 of the Bastrop City Code, supercedes any contrary provisions
previously adopted by the Council. Any provisions of "Schedule
IV: Yield Signs" that are not amended hereby shall remain in full
force and effect. This Ordinance does not rescind the authority for
or effectiveness of any existing one-way stops currently located within
the City that have been previously approved by the City Council.
PART 8. This amendment
to "Speed Limit - Special Schedules," referenced in Section
10.503 of Chapter 10 of the Bastrop City Code, supercedes any contrary
provisions previously adopted by the Council. Any provisions of "Speed
Limit - Special Schedules" that are not amended hereby shall remain
in full force and effect. This Ordinance does not rescind the authority
for or effectiveness of any existing speed limit zone signs currently
located within the City that have been previously approved by the City
Council.
PART 9. Copies of
the amended "Schedule II: Four-Way Stops," "Schedule
III: Stop Signs," "Schedule IV: Yield Signs," and "Speed
Limits - Special Schedules" shall be kept on file in the office
of the City Secretary.
PART 10. If any provision
of this ordinance or application thereof to any person or circumstance,
shall be held invalid, such invalidity shall not affect the other provisions,
or application thereof, of this ordinance which can be given effect
without the invalid
provision or application, and to this end the provisions of this ordinance
are hereby declared to be severable.
PART 11. This Ordinance shall take effect upon passage and approval,
in accordance with the laws of the State of Texas.
