ORDINANCE NO. 2003-32

AN ORDINANCE OF THE CITY OF BASTROP, TEXAS, PROVIDING FOR THE AMENDMENT OF THE CITY ORDINANCE RELATED TO THE MUNICIPAL COURT TECHNOLOGY FUND FOR THE CITY OF BASTROP, TEXAS; AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP, TEXAS:

WHEREAS, the 78th Legislature of the State of Texas enacted legislation allowing the governing bodies of municipalities to create, by ordinance, municipal court technology funds to finance the purchase and maintenance of technological enhancements for municipal courts, including but not limited to the purchase of computer systems, computer networks, computer hardware, computer software, imaging systems, electronic kiosks, electronic ticket writers and docket management systems, such legislation to be found in Article 102.0172 of the Code of Criminal Procedures; and

WHEREAS, the City of Bastrop, Texas desires to amend its existing Ordinance related to its Municipal Court Technology Fund to reflect this recent Legislative change.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP:

PART 1: The City Council of the City of Bastrop, Texas hereby amends its Ordinances related to its Municipal Court Technology Fund, pursuant to Article 102.0172 of the Code of Criminal Procedure, to provide for the use of such funds as allowed by the Legislature, to include maintenance of technological enhancements for its municipal courts.

PART 2: The Municipal Court Technology Fund shall be administered by or under the direction of the Bastrop City Council.

PART 3: This Ordinance shall take effect upon passage and approval, and as provided by law, but in no event sooner than September 1, 2003.

READ and Acknowledged on First Reading on the 23rd day of September 2003.
READ and Adopted on Second Reading on the 14th day of October 2003.
