AN ORDINANCE
AMENDING THE BASTROP CITY CODE, CHAPTER 4, TITLED BUSINESS AND COMMERCE,
ARTICLE 4.106; RELATED TO HOURS OF SALE OF ALCOHOLIC BEVERAGES; PROVIDING
A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BASTROP TEXAS:
PART 1: Sec. 4.106 -- "Hours of Sale" shall be amended
as follows:
Sec. 4.106 Hours of Sale
(a) No person shall sell or offer for sale any beer,
wine, or mixed beverages during the following periods of time:
(1) On Sunday, at any time between the hours of 1:00
a.m. and 12:00 noon, or between the hours of 1:00 a.m. and 10:00 a.m.,
if the alcoholic beverage is provided during the service of food to
the customer.
(2) On any other day, at any time between the hours of 12:00 midnight
and 7:00 a.m.
(b) No person shall consume or hold for the purpose
of comsumption in any public place any alcoholic beverages during
the following periods of time:
(1) On Sunday at any time between the hours of 1:15
a.m. and 12:00 noon.
(2) On any other day at any time between the hours of 12:15 a.m.
and 7:00 a.m.
[All provisions of Sec. 4.106 not specifically amended herein remain
as stated in the City Code of Ordinances.]
PART 2: Severability: If any section, subsection, sentence,
clause, phrase, or portion of this Ordinance is, for any reason, held
invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent
provision and such holding shall not affect the validity of the remaining
portions of this order.
PART 3: Disclaimer: This ordinance shall not create liability
on the part of the community or any official or employee thereof for
any damages that result from reliance on this order or any administrative
decision lawfully made thereunder.
PART 4: Effective Date: The provisions of this Ordinance shall
take effect immediately after passage and in accordance with applicable
law .
